This page is a placeholder written in plain English. It will be refined by Sevah's attorney before commercial launch and is not legal advice. The signed agreement with each facility controls in the event of a conflict.
These terms apply to
- Facilities running a Sevah pilot or commercial deployment.
- Authorized facility employees accessing the Sevah console.
- Families whom a facility has authorized to receive updates and connect via Companion.
Pilot program
- 30-day pilots are governed by a separate Pilot Agreement signed at the facility level. The pilot offer is per-room monthly pricing with a visible cancel button and no procurement-cycle commitment. Specific terms (pricing, scope, support) are in that signed agreement.
Acceptable use
- Don't attempt to access another facility's data.
- Don't reverse engineer the device firmware.
- Don't use Sevah's output as a substitute for licensed clinical judgment. Drafts require nurse review and signature before they become part of the medical record.
Service availability
- We aim for high availability but do not currently offer a contractual SLA. We will earn it.
- We will notify customers in writing of any unplanned outage affecting their facility.
Intellectual property
- Sevah retains ownership of the device firmware, the CareOS platform, the Companion product, and the Sevah brand.
- Customer data belongs to the customer. We are processors, not owners.
Liability
- Sevah does not provide medical advice. Companion's role is observation, prompting, and documentation drafting — never autonomous clinical decisions.
- Maximum liability is capped at the fees paid in the preceding twelve months, except in cases of gross negligence or willful misconduct.
Termination
- Either party may terminate the pilot at any time. Commercial customers may terminate per the terms of their signed agreement.
Governing law
- Delaware law. Disputes resolved in the federal or state courts of Delaware unless we agree otherwise in writing.
Changes
- We will update these terms as the business evolves. Material changes will be communicated in writing.
